Welcome to tortly.io (the "Site"), operated by Tortly ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.
1. Services Overview
Tortly is a mass tort marketing agency that provides lead generation, paid media management, intake operations, and related services to plaintiff law firms ("Clients"). The Site provides information about our services and allows prospective Clients to submit inquiries through our contact form.
The Site is informational. Submitting a contact form does not create a client relationship, contract, or obligation on either party. Service agreements are established through separate written contracts.
2. Eligibility
The Site and our services are intended for legal professionals, law firms, and authorized representatives of law firms. By using the Site, you represent that you are at least 18 years old and have the authority to agree to these Terms on behalf of yourself or your organization.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Submit false, misleading, or fraudulent information through the contact form
- Attempt to interfere with, disrupt, or compromise the Site's security or infrastructure
- Use automated systems (bots, scrapers) to access or interact with the Site without our written consent
- Transmit any viruses, malware, or other harmful code

Information submitted through our contact form is used solely for the purpose of responding to your inquiry and evaluating potential business relationships. By submitting the form, you consent to being contacted by Tortly at the email address and/or phone number you provide.

Nothing on the Site constitutes legal advice. Tortly is a marketing services provider, not a law firm. We do not provide legal counsel, and no attorney-client relationship is formed through use of the Site or our services.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
While we strive to keep information on the Site accurate, we make no guarantees regarding the completeness, accuracy, or timeliness of any content, including case volumes, statistics, or service descriptions.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TORTLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability for any claim arising from your use of the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Tortly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.

11. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Effective Date." Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.
By using the Site, you consent to the jurisdiction of such courts regardless of your location. Nothing in these Terms limits our ability to seek injunctive or equitable relief in any jurisdiction where such relief may be available.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tortly regarding use of the Site and supersede any prior agreements or understandings.
